Terms and conditions (TOS)
Read this thoroughly as a first-time customer, or if you haven’t read this before it was edited on 3/2/2025. Though feel free to skip over TOS portions that do not apply to your situation. (Every portion is titled correctly)^{____________________________}ALL PRODUCTS
1. All products are for personal use ONLY
Unless we have discussed a commercial license and come to a mutual agreement.2. I have the right to end conduct and instantly refund if warnings of behaviour are continued after 2 warnings.
^{(Ex: Sexual comments in SFW settings, rude and hostile remarks, spam while I’ve been commutative.)}3. Me and the client will maintain (semi) professional contact until the product has been finalized.4. You have the funds upon/soon after contact and won’t need to request a refund due to financial issues, unless it’s an unexpected emergency.
If refunds are necessary, the client will be suspended from purchases for 6 months to ensure their situation has recovered enough to commission again.5. The client has the right and should point out mistakes that may affect the product,
with each control check I do with the client, the client must point out my mistakes instantly by any means. The client understands some mistakes can’t be fixed in the next control check step if they fail to do so.6. I won’t accept funds or start working until you’ve clearly stated you agreed to what we’ve discussed.
Repeated failure to give an answer to my confirmation question may result me ceasing to reply.7. All purchases are done by adults (18+) due to the services I use to accept funds.
^{A. Digital products can’t be purchased through an adult for a minor, if this is broken,
BOTH are banned from future conduct indefinitely.
B. Age-appropriate physicals and physical customs can be purchased by an adult for a minor,
but the adult must contact me and is responsible for payment and gifting this item to them,
I will never ask for a minor’s address unless it’s shared with the adult.
(Minors contacting me and the adult paying without communication is not allowed)}8. I may and have the right to decline and refuse service, with the reasoning being stated or not, and this must be respected. (Money will never be held hostage)9. -DIGITAL ART-
_{^{Are you getting artwork from me with an existing character (as in; I don't have to design a character)? Then you'll have to read this!}}0. The client will be upfront and clear with what they want, and will not try to lie about intentions to avoid costs intentionally. The client will never be shamed by me for what they want and understands I only try to assist. All messages will be kept private.1. Regardless of license, credit must always be provided, which must be clear and not obscured by hiding it intentionally.
^{A. Putting my credits on a credits page with other artists is accepted, as long the link isn’t hidden and/or unclear.
B. If reuploaded, my credit shouldn’t be obscured by a wall of text or image, it must be on the top or bottom, at normal size and not minimalized.
C. For products, the watermarked version must be used UNLESS we have a commercial license.}2. Once received, you’re allowed with your personal usage license: Make small scale (less than 10) production which should not profit you and isn’t used to promote anything without a license upgrade3. Full refunds are only provided before the sketch has been started/before the first control check, after that, it’ll only be a partial refund depending on the state of completion.4. The client will receive a watermarked an unwatermarked file of the art, the unwatermarked version should ALWAYS be kept private and shouldn’t be shared publicaly , the watermarked version can be freely shared everywhere. This is to avoid unauthorized use by third parties, I may void help in take-down requests if you ignore this.5. Edits may be made, up to a degree: Flipping, rotating, cropping, etc is allowed, minor edits with programs such as editing to make the art “up-to-date” after time passed, add non-political objects, identity flags/markings is allowed.
Adding/editing text is not allowed*, edits to stir drama or offense towards anyone, adding sexual edits on nonsexual art is not allowed.6. You're responsible for archiving your art, I may not be able to recover old commissions. If it has been more than a month, you must give a (rough) date and I'll try to search for it.*^{Why not allow text edits? It’s more trouble than it’s worth, I can make a list of yes and no of what you can add... But that’s too authoritative for my liking. I rather just not allow it than play police.}

-CUSTOM CHARACTER DESIGN-
_{^{Are you purchasing/commission a character design I've made? (As in; you buy the art FOR the character design, so you own it and use it) Then you'll need to read this!}}0. If the art is premade, you only need to read this! Rules that still apply will be highlighted. In regards to credit, depends per site! Ask me and tell me where you'd use them, but the safe choice is to link here either way!1. No refunds will be given if the art is pre-made due to art being already completed, if not pre-made, read the DIGITAL TOS as it applies.2. Rule 4 and 1 of the DIGITAL TOS applies, you'll receive the unwatermarked version once payment is received.3. Characters sold are priced for PERSONAL use, for commercial use, contact me and I'm happy to figure out a price! You may contact me at a later date as well, as long you notify me as soon as possible.4. For editing and using the pre-made art, rule 5 and 1 applies from DIGITAL TOS5. Once payment has been processed, the character is all yours to do with as you will. I will NEVER:
-Disallow/force changes in design
-Lock/disallow you to sell or trade this character
-Attempt to "reclaim" the character for any reason
-Tell you what you can't/can do with it
-Or anything that disrespects your ownership of your paid-off characterHowever, I'm free to decide if I'd continue working with you depending on how you use this character. (ex; using it in controversial artworks, use it to harass people, go against my beliefs, general offensive usage)6. You are not allowed to flip/profit from the character if there's no additional works, once you've added art, stories, or etc to this character, you're free to sell it more than its original price.*
*I may refuse to sell to you again if you try to resell your purchase for a massive upcharge that's not reflective of its actual worth. (ex; charging 2,000 profit for a sketch which was made by you or commissioned less than that amount)7. Redesigned the character to the point it's not recognizable from the original form? I'm happy to discuss about dropping credits!
_{There'll be no set agreement due varying situations, we'll figure what's fair to both of us}8. Don't make clone designs of your purchased character, this is to avoid my style being duplicated w/o consent and the issues around selling/trading these.
^{A. You're free to make alternative designs THAT are attached to this character (Alternative universe, transformed or different forms, etc) as long they're not separated when traded/sold.
B. Making familial designs that hold some resemblance with enough distinction is fine, as long it's more than a few marking and color changes, if it's got a different silhouette, you're fine.
C. Rule A can be discussed if it's similar to a rule 7 situation.}In regards to crediting; you don't have to credit me every time you use your character! Credit me on their character/info page (like Toyhou.se, personal sites, etc) or/and on the refsheet. Please credit me when you post about them for the first time! Don't mislead people that you made the design or claim it as your own.

^{_{I'm against the practice of public blacklists, especially for interpersonal relationships stuff. If you want to gift to someone with an online presence, you have to let me know who it is. If lied about, I won't accept business with you again.}Only people who purchased character designs from me may ask for my personal list I rather have my designs not go to, but I'll only consider it a kind gesture rather than a requirement. No need to ask unless you plan to trade/sell it later, even less so if you plan to retire/delete/private/etc if you've lost interest in the design.I don't work with people who: keep breaking/disrespecting my TOS, engage often in drama or had a major enough scandal, scammed, artists with a documented history of failing to deliver commissions/refunds, unprofessional/hostile communication, acted inappropriately with minors in any way, harmed people/animals in real life, bigoted/went against my beliefs, etc. I rarely add people outside that reasoning._{My personal list is not a callout list, therefore it's not publicly shared or why someone is on it. I've no interest at all to host any form of callouts/bewares, and will only be a last resort for my safety.}}
